  • Kolma AG uses your personal data exclusively for the purpose of conducting business or providing our online service (KolmaCreator).
  • Your personal data is stored in our company and by our processors (e.g., agencies that carry out campaigns for us). If your personal data is transferred, it is encrypted.
  • Insofar as you have provided us with personal data, we generally do not pass it on to third parties. Any transfer to companies outside Kolma AG only takes place within the framework of consent you have provided, for the purposes of processing your enquiries, and in the context of your use of our services, and to commissioned subcontractors who receive the necessary data to carry out commissioned data processing. How do we use your data, and what is the legal basis for this?

What data do you need to provide?

Providing your name, surname, address and a current email address is mandatory if you place an order with us or if you want to participate in a competition or promotion. If you do not provide this data, we will not be able to fulfil orders and enable your participation in competitions and promotions.

The provision of further data is optional. If you do not provide a telephone number, this may result in delays in dealing with complaints and service requests, for example, if we are unable to reach you by telephone.

In the context of applications for vacancies, you may provide information that is considered “particularly sensitive personal data”.

 

How can you withdraw any consent you may have provided or object to the sending of direct marketing?

In all cases in which you have given us your consent to data processing, you can withdraw this consent at any time. In this case, we will terminate the data processing based on that consent.

In some cases, we may send you direct marketing without your consent. In this case, you have the right to object to direct marketing at any time (“Opt out”). You can do this by following the instructions we provide in the communication, if it is an electronic message. Alternatively, you can contact us using the details below.

 

With whom, where and when do we share this data?

We may transfer your personal data to implement orders, for competitions or for other marketing campaigns you have registered for. In some cases, we transfer your data to agencies or service providers in order to implement orders, competitions or other marketing campaigns you have registered for.

If we are requested to do so by administrative or law enforcement authorities, we will transfer this personal data to the extent required by law, or if this is necessary to protect our legitimate interests in accordance with applicable laws.

We also pass on your personal data to commissioned processors who process this data on behalf of Kolma AG for the above-mentioned purposes. These processors include providers of website hosting and of maintenance, advertising agencies, shipping and logistics service providers, and analysis services.

If a division of our company is sold or integrated into another company, we may disclose your data to our consultants and the potential buyer’s consultants and pass it on to the new owners of the company.

We will only transfer data to recipients outside the European Economic Area if this is necessary to fulfil a contract or if sufficient data protection is ensured; this is the case, for example, if the country concerned is subject to an adequacy decision by the Commission of the European Union or if the data is adequately protected by standard contractual clauses approved by the EU Commission, a corresponding Privacy Shield certification, or the binding company rules of the processing provider.

 

Tracking via Google Analytics

We use Google Analytics to analyse your use of our websites. In this context, we transfer data on the use of our websites to our commissioned processor, Google Inc. Google Analytics is configured in such a way that your IP address is transferred to Google anonymised (anonymizeIP). Google creates statistical reports on the use of our websites for us.

If you do not want to allow tracking by Google Analytics, you can install a browser add-on that will prevent this tracking by Google Analytics.

 

Use of Google Maps

This website uses the Google Maps product from Google Inc. By using this website, you consent to the collection, processing, and use of data collected automatically by Google Inc., its representatives, and third parties.

What rights do I have?

You have the following rights:

Which Kolma AG department is responsible for my data?

Your data will generally be processed in the departments responsible for the processing purpose in question. These can include the Sales, Procurement, Logistics, Marketing, IT, Finance, and Human Resources departments.

In individual cases, other departments may also access your data, e.g., the Legal department in the event of a legal dispute.

 

How long will my data be kept for?

When we process registration data, we do so for as long as you are an active user of our websites. If we process personal data for marketing purposes or with your consent, we will do so until you ask us to stop processing it, and for a short time thereafter (so that we can implement your requests). We also record indefinitely that you have asked us not to send you direct marketing or process your data, so that we can continue to comply with your request in the future.

When we process personal data for website security purposes, we store it for as long as you are an active user of our websites.
